Mr. Alain Serge Kasende M’bay is a Barrister registered with the Bar of Kinshasa/Gombe since 28 February 1996, he holds an LLD from the university of Kinshasa and degree in social law from the University of Liège and degree in human rights from the Catholic University of Antwerp. He truly a general practitioner of law and works specifically in the following fields:
Social and labour relations law – Mr. Alain Serge Kasende M’bay advises and assists clients in the drafting and negotiation of documents and other deeds that are necessary for the professional life (labour contract and other agreements, labour regulations, terms and conditions of service). He also advises and assists in labour audit, abusive or unfair dismissal, harassment at workplace, equality treatment, discrimination, difficulties linked to arrears of pay, to overtime, to fake independents contractors, competition against the employer after dismissal, defense of rights subsequent to bankruptcy, issues on indemnification following an accident at workplace, disputes arising from registration at INSS or within the framework of labour laws and in negotiation within the framework of individual and collective conflicts.
Commercial law, companies law and investments law - Mr. Alain Serge Kasende M’bay advises and assists clients in associates pacts in private companies, in business or social offences, in discussions for the contracting of services, as well as in the restructuring of companies. He also advises and assists for the incorporation of commercial companies and in various meetings of general assembly, board of directors meetings, management meetings and in other meetings of associates and shareholders. He further advises in the drafting and the conclusion of deeds relating to the transfer of working capitals. He finally works in the financing, audit, transfer of shares and company acquisition, securitization, organizing the process of sales and call for bids, transfer and acquisition of real estate portfolios and credits.
Real estate and lease litigation law -Mr. Alain Serge Kasende M’bay advises in the drafting and conclusion of various deeds relating to real estate sales, acquisitions and promotions (acquisition of land and urbanism fund, structuring of funding operations, financial and tax engineering, construction and monitoring of construction sites). He also intervenes in the capacity of legal counsel in the management of real estate assets (commercial leases, co-ownership, encumbrances, assets management and administration contracts).
Energy and hydrocarbon law -Mr. Alain Serge Kasende M’bay advises and assists clients in negotiations for oil agreements (production sharing contract), in securing importation, transport and storage authorizations for fuels, in securing road administration permission for the transmission of electricity and authorizations for the building of power plants as well as in the drafting and negotiation of contracts for production, distribution and commercialization transfer of electrical energy. Mr. Alain Serge Kasende M’bay is also member of the French Association of Oil Experts and Professionals.
Mr. Alain Serge Kasende M’bay is one of the lawyers who have recently been practicing in foreigners, expatriates and international mobility law in the DRC. In this regard, he advises and assists clients on issues related to visas and other DRC stay documents, in stay and nationality disputes. He also participates in many works on the examining the conformity and authenticity of marital status deeds submitted to the scrutiny of the firm by embassies and diplomatic missions
