Mining legislation and regulations of Democratic Republic of the Congo are tackled and analyzed in this book. One finds herein historical origins of our Codes and mining Regulation, briefly and precisely redrawn. The study provides extracts of debates and preparatory works.

One finds herein historical origins of our Codes and mining Regulation, briefly and precisely redrawn. The study provides extracts of debates and preparatory works. It shows the application of legislation and mining regulations in front of Courts and Tribunals, and this, since Independent State of the Congo to this day. In this study, Congolese mining legislations and regulations are not analyzed in an isolated way. They are compared to modern mining codes such as the French, the Senegalese, the Ivorian, the Malian, the Burkinabe and others to make stand out differences and similarities. After showing the mining sector importance in economical and social development and having released the management guidelines in the State mining area, this work briefly analyzes acquisition and exercise methods of mining rights, that is: Personal Authorisation for Prospecting, Research Permit, Exclusive Zone of Research, Mining Convention, Preliminary Agreements, Handicraft Exploitation Permit and Digger’s Card, the Concession, the Amodiations and Transfer of mining rights. Juridical reports between mining rights holders, the State and the thirds are also analysed in this work. Obligations of mining rights holders towards the State, their responsibility for surface damages, damages caused to mining rights holders by the thirds and the deeds of which mines can the subject were developed throughout this works. |
